1. Who we are
YoSwinger is operated by HotAdvertising Communications (ABN 45 096 683 198), 1101 Stud Rd, Rowville VIC 3178. Contact: [email protected].
2. Who can join
- You must be 18 or older. We check your date of birth at sign-up, and we require verified age assurance before you can see or share explicit photos.
- Couples share one account; both partners must be 18 or older.
- One account per person or couple. Accounts are personal and must not be sold or shared.
3. Your content
- You may only upload photos you took or own, showing adults who agreed to them being shared on YoSwinger. You confirm this every time you upload.
- We remove location data (GPS) from photos automatically, and every photo is checked by a moderator before other members can see it.
- You keep ownership of your content. You give YoSwinger permission to store and display it to the members you choose, only for running the service.
4. Behaviour
Members must follow our Community Guidelines. In short: consent first, no harassment, no minors, no sharing other people's images without consent, no scams or selling.
5. Premium membership and payments
- Premium is optional. Plans renew automatically until cancelled; you keep Premium until the end of the paid period.
- Payments are processed by CCBill. YoSwinger never sees your card details. Charges show on your statement under CCBill.
- Prices are in Australian dollars and include GST.
6. Suspension and closing accounts
- We may suspend or close accounts that break these terms or the Community Guidelines, or where required by law. Moderator actions are recorded.
- You can delete your account at any time in Settings. This permanently deletes your profile, photos and messages.
7. Liability and disputes
Your rights under Australian law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Meeting other members. YoSwinger is a place for adults to find and contact each other. We do not check every member's identity, background or health, and we do not employ, supervise or endorse members or the events and venues they list. You choose who you talk to and meet, and you are responsible for your own decisions and safety. Please read the safety advice in our Community Guidelines.
Content from members. Members are responsible for what they post. We moderate content and act on reports, but we cannot promise to find everything that breaks our rules, or that information on a member's profile is accurate.
The service. We try to keep YoSwinger available and secure, but it may sometimes be unavailable, and we can change or stop features. Please keep your own copies of anything important to you.
Limits on our liability. To the extent the law allows, we are not liable for:
- loss or harm caused by another member or by anything that happens when members meet;
- content posted by members or provided by other websites and services; or
- indirect or consequential loss, including lost profits, lost data or loss of reputation.
To the extent the law allows, our total liability to you for anything connected with YoSwinger is limited to the amount you paid us in the 12 months before the claim arose. Where the Australian Consumer Law applies and our liability can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again. These limits do not apply to loss caused by our fraud or to anything else the law does not allow us to limit.
If something goes wrong. Please contact us first using our contact and complaints page, so we can try to fix it. This does not stop you going to a regulator such as the eSafety Commissioner, the Office of the Australian Information Commissioner or a consumer protection agency, or starting legal action.
Governing law. These terms are governed by the laws of Victoria, Australia. You and we agree to the non-exclusive jurisdiction of the courts of Victoria, and you keep any right the law gives you to bring a claim elsewhere.
